Terms & Conditions
Introduction
These Terms and Conditions explain the basis on which Designer Furniture Co. Ltd supplies products through www.designerfurniturecompany.com.
Please read them carefully before placing an order. By placing an order with us, you confirm that you have read and accepted these Terms and Conditions.
Nothing in these terms affects your statutory rights.
1. About Us
This website is operated by Designer Furniture Co. Ltd, a company registered in England and Wales.
Registered company name: Designer Furniture Co. Ltd
Company registration number: 13449243
Registered office: 128 City Road London EC1V 2NX
Email: support@designerfurniturecompany.com
Telephone: +44 (0) 203 937 7918
In these terms, “we”, “us” and “our” refer to Designer Furniture Co. Ltd. “You” and “your” refer to the person or business placing an order.
2. Who Can Place an Order?
You must be at least 18 years old and legally capable of entering into a binding contract to place an order through our website.
Products may be purchased by private consumers or trade customers. Additional or different terms may apply to trade orders, bespoke projects and purchases made wholly or mainly for business purposes.
3. Product Information
We take reasonable care to ensure that product descriptions, measurements, photographs, specifications and prices are accurate.
However, please be aware that:
Colours may appear differently depending on your screen, lighting and surroundings.
Measurements are approximate and may be subject to reasonable manufacturing tolerances.
Natural materials such as wood, marble, travertine, leather and stone will display variations in grain, colour, veining, texture and pattern.
Handmade, hand-finished and antiqued products may contain minor variations that form part of their character.
Fabrics from different production batches may vary slightly in shade or texture.
These natural or reasonable manufacturing variations are not normally considered faults.
Decorative accessories shown in lifestyle photographs are not included unless specifically stated in the product description.
We may make minor changes to a product where necessary, provided those changes do not materially affect its appearance, quality or function.
4. Checking Measurements and Access
You are responsible for checking all product measurements before ordering.
Please ensure that the product will fit:
In its intended position;
Through entrance doors and internal doorways;
Along hallways and around corners;
Through staircases or lifts; and
Through any other restricted access points.
You should also check that floors, walls and access routes are suitable for the product and delivery method.
If a product cannot be delivered because of insufficient access, unsuitable premises or incorrect measurements supplied by you, we may charge for the failed delivery, storage, redelivery or return of the product.
5. Placing an Order
After placing an order, you will receive an order acknowledgement by email. This confirms that we have received your order but does not necessarily mean that we have accepted it.
A contract between you and Designer Furniture Co. Ltd is formed when we:
Send you confirmation that your order has been accepted;
Confirm that the product has been dispatched; or
Begin production of a bespoke or customised product, whichever occurs first.
We reserve the right to decline or cancel an order before acceptance. This may happen if:
The product is unavailable;
The price or product information contains an obvious error;
We cannot authorise or verify your payment;
We cannot deliver to your address;
You do not meet our eligibility requirements; or
We reasonably suspect fraudulent or unauthorised activity.
If payment has already been taken for an order we cannot accept, we will issue a refund.
6. Prices and Payment
Prices are displayed in pounds sterling unless another currency is selected.
Prices include VAT where applicable but exclude any separately stated delivery, installation, assembly or white-glove service charges.
The total amount payable will be shown during checkout before you submit your order.
We accept the payment methods displayed at checkout. Payment must be successfully authorised before an order can be processed, unless written credit terms have been agreed with an approved trade customer.
If a product is listed at an obviously incorrect price, we are not required to supply it at that price. We will contact you to explain the error and give you the option of proceeding at the correct price or cancelling the order for a full refund.
7. Discount Codes and Promotions
Promotional codes must be entered at checkout and cannot normally be applied retrospectively.
Unless otherwise stated:
Only one promotional code may be used per order;
Codes cannot be exchanged for cash;
Promotions may exclude sale products, selected brands or specific collections; and
Promotions may be withdrawn or amended at any time before an order is placed.
If an order is returned, any refund will reflect the amount actually paid after the discount was applied.
8. Product Availability
All products are subject to availability.
Stock information and estimated lead times are provided in good faith, but occasional discrepancies may occur. If a product becomes unavailable after you order, we will contact you and offer an appropriate alternative, revised lead time or refund.
For orders containing several products, items may arrive separately or be held until the complete order is available. We will tell you when separate delivery arrangements or additional charges apply.
9. Pre-Order, Made-to-Order and Bespoke Products
Some products are sourced, manufactured or reserved specifically after an order is placed. Estimated lead times will be shown on the product page or provided before purchase.
Lead times are estimates and may be affected by production schedules, shipping, customs clearance, port congestion or other circumstances outside our reasonable control.
We will keep you informed if there is a significant delay.
A product is not considered bespoke merely because it is temporarily out of stock or ordered from a supplier. However, products manufactured to your individual measurements, fabric, finish, colour or other personalised specification may be treated as bespoke or customised.
Cancellation rights may not apply to genuinely bespoke or personalised products once production has started. This does not affect your rights if the product is faulty, damaged, not as described or incorrectly supplied.
10. Delivery
Delivery options, estimated lead times and any applicable charges will be shown during checkout or confirmed separately.
Unless otherwise agreed, standard furniture delivery is generally made to a ground-floor room with safe and reasonable access. Delivery above ground floor, assembly, installation, packaging removal or furniture positioning is only included where expressly stated or where a white-glove service has been purchased.
Delivery dates and times are estimates unless we have expressly agreed a fixed delivery date in writing.
You must ensure that:
An adult is available to accept the delivery;
The delivery address and contact details are correct;
The property can be accessed safely by the delivery team;
Access routes are clear; and
Fragile flooring, walls and surrounding furnishings are suitably protected.
If nobody is available, access is unsafe or delivery cannot be completed for reasons within your control, additional storage, return or redelivery charges may apply.
11. Delivery Delays
We will take reasonable steps to deliver your order within the estimated timeframe.
We are not responsible for delays caused by events outside our reasonable control, including severe weather, transport disruption, port congestion, customs delays, industrial action, supplier interruption or other force majeure events.
If a delay becomes significant, we will contact you and explain the available options. Your statutory rights regarding delivery remain unaffected.
12. Ownership and Responsibility for Products
You become responsible for the product when it is delivered into your physical possession or to a person identified by you to receive it.
Ownership of the product passes to you once we have received payment in full.
Nothing in this section limits your rights if a product is delivered damaged, faulty, incorrectly supplied or not as described.
13. Inspecting Your Delivery
Please inspect your order as soon as reasonably possible after delivery.
If there is visible damage to the packaging or product, please note this on the delivery paperwork where possible and photograph the packaging before it is removed.
We ask that delivery damage, missing components or incorrect products are reported within 48 hours so that we can investigate promptly with the delivery company. However, failure to report an issue within 48 hours does not remove any statutory rights you may have.
Do not assemble, install or continue using a product if you believe it is damaged or unsafe.
14. Your Right to Cancel an Online Order
If you are purchasing as a consumer, you normally have the right to cancel an eligible online order without giving a reason.
You must tell us that you wish to cancel within 14 days beginning on the day after you, or a person nominated by you, receives the product.
After notifying us, you normally have a further 14 days to return the product.
To request a cancellation, contact:
Email: support@designerfurniturecompany.com
Telephone: +44 (0) 203 937 7918
Please include your name, order number and the product you wish to return.
Certain products are excluded from the cancellation right, including products made to your personal specification or clearly personalised. Other statutory exclusions may also apply.
Please see our Returns Policy for complete return instructions.
15. Change-of-Mind Returns
Products returned following a change of mind must be:
Unused and unassembled;
In resalable condition;
Complete with all parts, instructions and accessories; and
Returned in the original packaging where reasonably possible.
You are responsible for taking reasonable care of the product while it is in your possession.
You may examine the product as you would reasonably be permitted to do in a shop. We may reduce the refund to reflect any loss in value caused by unnecessary handling, use, assembly, damage or inadequate return packaging.
Unless the product is faulty, damaged, incorrect or not as described, you are responsible for the direct cost of returning it. Large furniture may require a specialist furniture collection service, and the cost can be significant.
We will not impose a general restocking fee on a consumer exercising a valid statutory cancellation right.
16. Refunds
For an eligible consumer cancellation, we will refund:
The price paid for the returned product; and
The cost of our least expensive standard delivery method, where required by law.
Additional delivery charges paid for an enhanced, timed or white-glove service are not refundable beyond the cost of the least expensive standard delivery option, unless the product was faulty or we failed to provide the agreed service.
We may withhold the refund until we receive the returned product or you provide evidence that it has been sent back, whichever occurs first.
Refunds will normally be made within 14 days of receiving the returned product or acceptable evidence of return. The refund will be issued to the original payment method.
17. Faulty, Damaged or Incorrect Products
We are responsible for supplying products that are:
Of satisfactory quality;
Fit for any purpose made known to us;
As described; and
Supplied in accordance with the contract.
If a product is faulty, damaged on delivery, incorrectly supplied or materially different from its description, please contact us as soon as possible with:
Your order number;
A description of the issue;
Photographs or video showing the problem; and
Photographs of the packaging where relevant.
Depending on the circumstances and your statutory rights, we may offer repair, replacement, a price reduction or refund.
We will cover reasonable return or collection costs where a product is confirmed to be faulty, damaged, incorrect or not as described.
Your legal rights under the Consumer Rights Act 2015 are not affected by any manufacturer’s warranty or commercial guarantee.
18. Assembly, Installation and Product Care
Products must be assembled, installed, used and maintained in accordance with the supplied instructions.
Wall-mounted or anti-tip furniture must be secured using fixings appropriate for the wall construction. If you are uncertain, you should use a suitably qualified professional.
Lighting and electrical products requiring installation must be installed by a qualified electrician in accordance with applicable UK regulations.
We are not responsible for damage caused by:
Incorrect assembly or installation;
Unsuitable wall or floor fixings;
Failure to follow care instructions;
Accidental damage, misuse or neglect;
Unauthorised alterations or repairs;
Abnormal commercial use where the product is intended for domestic use; or
Normal wear and tear.
This does not limit our responsibility for defects that were present when the product was supplied.
19. Manufacturer’s Warranty
Where stated, a product may include a manufacturer’s warranty covering qualifying manufacturing defects for the specified period.
Warranty claims may require proof of purchase, photographs, inspection or return of the product.
A warranty does not normally cover accidental damage, misuse, improper assembly, normal wear and tear, commercial use of a domestic product or natural variations in materials.
A manufacturer’s warranty is provided in addition to, and does not replace, your statutory rights.
20. Trade and Business Customers
If you purchase wholly or mainly for business purposes, you are a business customer rather than a consumer.
Consumer cancellation rights do not apply to business purchases. Trade orders, project orders and business purchases may be subject to separate written quotations, pro forma invoices, credit terms or trade account conditions.
Unless agreed otherwise in writing:
Payment must be received before dispatch;
Delivery dates are estimates;
Products must be inspected promptly upon delivery; and
Bespoke, made-to-order and specially sourced products cannot be cancelled after production or procurement has begun.
Nothing in these terms excludes liability that cannot legally be excluded.
21. Our Liability
We do not exclude or limit liability where it would be unlawful to do so, including liability for:
Death or personal injury caused by our negligence;
Fraud or fraudulent misrepresentation;
Breach of your statutory rights relating to products; or
Any other liability that cannot be excluded under applicable law.
If you are a consumer, we are responsible for foreseeable loss or damage caused by our breach of contract or failure to use reasonable care and skill.
We are not responsible for business losses suffered by consumers, including loss of profit, revenue, business opportunity or commercial interruption.
Different liability provisions may apply to business and trade customers under separately agreed written terms.
22. Events Outside Our Control
We are not responsible for a failure or delay in performing our obligations where it is caused by an event outside our reasonable control.
If such an event affects your order, we will contact you as soon as reasonably possible and take steps to minimise the effect of the delay.
Your statutory rights, including any right to cancel following a significant delay, remain unaffected.
23. Website Use and Intellectual Property
The content of this website, including its text, photography, graphics, branding, logos and page design, is owned by or licensed to Designer Furniture Co. Ltd and is protected by intellectual property laws.
Content may not be copied, reproduced, republished, distributed or used commercially without our prior written permission.

24. Personal Information
We process personal information in accordance with our Privacy Policy.
We use your information to process orders, arrange delivery, provide customer service, prevent fraud and meet our legal and regulatory obligations.
25. Complaints
If you are unhappy with a product or service, please contact us so that we can try to resolve the matter.
Please provide your order number and a clear description of the issue.
26. Changes to These Terms
We may update these Terms and Conditions from time to time.
The terms applying to your purchase will normally be those published on our website when your order was placed, unless a change is required by law or agreed with you.
27. Severability
If any provision of these terms is found to be unlawful or unenforceable, the remaining provisions will continue in full force and effect.
28. Governing Law
These terms are governed by the laws of England and Wales.
If you are a consumer residing elsewhere in the United Kingdom, you may also benefit from mandatory protections available under the law of your place of residence and may bring proceedings in the courts permitted by applicable law.
If you are a business customer, the courts of England and Wales will have exclusive jurisdiction unless otherwise agreed in writing.
